As much as I hate non-responsive replies...
I hiked down this road on the 21st. I think the gate is less of an issue than the washout around 0.5 mile short of Lupine C.G.

You pose a rather interesting question Mr. Greg. Are the Towhees always spotted when they're spotted? Perhaps their coloration is sex, season or age affected. Thus they may not be spotted when spotted.
